Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Story Project (the "Service"), operated by Bradley Jay LLC ("we", "us", "our"). By creating an account or continuing to use the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you confirm that you have authority to bind that organization. If you are using the Service as an individual, you confirm that you are of legal age in your jurisdiction.

The Service

The Story Project sends weekly story prompts to a senior storyteller, lets them record video responses with one tap, and organizes those recordings — plus transcripts and Vault deliveries — in a private family archive.

Your account

  • Provide accurate information and keep it up to date.
  • Keep your credentials confidential. You are responsible for activity under your account.
  • You are responsible for invited family members' use of your workspace.

Acceptable use

You agree not to:

  • Use the Service unlawfully or to infringe anyone's rights.
  • Upload malicious code, spam, or content that violates law.
  • Probe, scan, scrape, or interfere with the Service's security or integrity.
  • Reverse engineer, resell, or redistribute the Service, or circumvent technical limits or plan quotas (including Vault slot limits).

Intellectual property

We retain all rights in the Service, including its software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan and these Terms.

Your content

You retain all rights to the stories, recordings, transcripts, and other content you and your family members submit ("Your Content"). You grant us a limited license to host, process, transcribe, and transmit Your Content solely to operate the Service for you. You are responsible for having the rights and consents needed for the content you submit.

Payments, subscriptions, and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Prices, applicable taxes, billing frequency, renewals, cancellations, and refunds are governed by the Paddle Checkout Buyer Terms and the Paddle Refund Policy, supplemented by our Refund Policy. Subscriptions renew automatically for the same term unless canceled before the renewal date.

Service level and warranties

We work hard to keep the Service reliable, but we do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly violate our policies. You may cancel at any time via your account or via Paddle. On termination, we will make Your Content available for export for a reasonable period, then delete or anonymize it in accordance with our Privacy Notice.

Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or exemplary damages, including loss of profits, revenue, data, or goodwill. Our aggregate liability arising out of or relating to the Service is limited to the fees you paid to Paddle for the Service in the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.

Indemnity

You will defend and indemnify us against third-party claims arising from Your Content, your violation of these Terms, or your unlawful use of the Service.

Governing law and disputes

These Terms are governed by the laws of the state in which Bradley Jay LLC is organized, without regard to conflict-of-laws rules. The state and federal courts located there have exclusive jurisdiction over disputes, except where mandatory local law provides otherwise.

Assignment; force majeure

You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in the app before they take effect. Continued use after the effective date constitutes acceptance.
